Arbitration


In Romanian law, arbitration is regulated in Book IV – On Arbitration, Articles 541–621 of the Romanian Code of Civil Procedure.
Internationally, arbitration is governed by instruments such as the Convention on the Recognition and Enforcement of Foreign Arbitral Awards (New York, 1958), the European Convention on International Commercial Arbitration (Geneva, 1961), and UNCITRAL Arbitration Rules.
Because arbitration is flexible (e.g., parties may choose the place of arbitration), even if a tribunal is located in Romania, if parties are from different states, the procedure takes on an international character.

AD-HOC ARBITRATION


Ad-hoc arbitration is a form of Alternative Dispute Resolution (ADR) whereby parties agree that a dispute will be resolved by one or more arbitrators, outside of courts, without the involvement of a permanent arbitral institution. Unlike institutional arbitration, ad-hoc arbitration gives parties full flexibility in choosing procedural rules, the place of hearing, the language, and the arbitrators. Parties may adopt pre-existing rules (e.g. UNCITRAL Rules) or use a customized regime tailored to the specific dispute, such as the rules implemented by the Ad-Hoc Arbitration Platform — Arbitru Ileana Lanzoni Nicolaescu in Carbini. This procedure is confidential, fast, and efficient, particularly suitable for commercial, civil, professional, or cross-border disputes. The arbitral award has binding effect and produces the same consequences as a court judgment, and can be recognized and enforced in Romania and other countries under the 1958 New York Convention. It is an independent professional structure created to facilitate the alternative resolution of civil, commercial, and professional disputes, both at the national and international levels. The platform’s activity is carried out in accordance with the principles of impartiality, confidentiality, independence, and promptness, offering the parties a balanced and transparent framework for resolving disputes.

MEDIATION


Mediation is an informal, confidential procedure in which parties freely express their viewpoints. It is a way to improve communication between parties, help participants identify the “core of the problem,” and typically involves short resolution times and lower costs compared to court or other alternative procedures.
The parties always retain control over decision making and are the only ones who adopt solutions.
The mediator listens, helps parties reframe, reformulate, summarize; assists them in identifying and focusing on aspects that matter to them; aids them in generating the maximum number of resolution possibilities; does not impose solutions on the parties.

TRAINING / COURSES


The association “Conciliation and Arbitration for Internal and International Justice (C.A.J.I.)” organized in the years 2022–2024, online, via Zoom, a professional training program in two modules for arbitrators, offering the possibility to become an arbitrator in ad-hoc arbitration and/or to become an arbitrator-judge within a permanent arbitration institution, namely the Institutionalized Arbitration and Conciliation Tribunal (Internal & International) attached to C.A.J.I., with a branch in Italy. The occupation “Arbitrator” has COR code 243221, CAEN codes 6910, 8423. Applications were made by filling out the registration form, indicating the choice of Module I and/or Module II, along with a CV demonstrating the candidate’s studies and interest in arbitration, and consent for personal data processing by C.A.J.I.

Înscrierile au fost făcute prin complectarea cererii de înscriere la curs, unde se preciza alegerea Modul I și / sau Modul II, împreuna cu un CV care să evidențieze studiile parcurse și interesul pentru arbitraj împreuna cu acordul de prelucrare a datelor cu caracter personal de către C.A.J.I.

Activitatea Internă și Internațională


(1) Ileana Lanzoni Nicolaescu in Carbini a fost invitată în emisiunea TVR „Cu capu-n zori” pentru a discuta despre procedura de arbitraj și avantajele acesteia față de instanțele tradiționale. În cadrul emisiunii, ea a subliniat importanța arbitrajului ca metodă eficientă și rapidă de soluționare a disputelor.

(2)  A fost invitată în emisiunea „Legal 100%” de la TVR 3, difuzată pe 8 aprilie 2022. În cadrul acestei emisiuni, ea a discutat despre diferențele dintre arbitraj și instanțele de drept comun, explicând avantajele arbitrajului ca metodă alternativă de soluționare a disputelor.

(3) A fost invitată în emisiunea „FRP-TV On-Line”, difuzată pe 10 august 2022, la ora 21:30. Emisiunea a fost organizată de Federația Românilor de Pretutindeni (FRP) și a fost transmisă online, având un impact semnificativ, cu peste 3.500 de vizualizări. În cadrul emisiunii, doamna Lanzoni Nicolaescu in Carbini a discutat despre arbitraj, mediere și soluționarea alternativă a disputelor, subliniind importanța acestor metode pentru comunitățile românești din diaspora.

CONCLUSIONS


In a modern society with complex legal relationships, fast and effective dispute resolution is essential. In addition to courts, modern law acknowledges alternative dispute resolution methods, of which the most important is arbitration. Arbitration gives parties the possibility to resolve disputes privately, by arbitrators chosen by mutual agreement, in a confidential, flexible, and efficient framework. Arbitration represents an alternative jurisdiction through which disputes between parties are resolved by private persons chosen by agreement, based on an arbitration agreement.
