WHAT IS THE ARBITRATION CONVENTION?
The arbitration agreement is concluded in writing under penalty of nullity (Art. 548 para. 1 C. proc. civ.). The document recording the arbitration agreement is usually under private signature and only by exception in authenticated notarial form, when the arbitration agreement refers to a dispute related to the transfer of the ownership right and/or the establishment of another real right over an immovable property (Art. 548 para. 2 C. proc. civ.) which may be the arbitration clause or the submission agreement.
